Terms of Service: Mass SMS Notifications

1. Service Overview:

The SMS mass notification feature allows campgrounds to send bulk text messages to their guests, facilitating streamlined communication directly through the RoverPass platform.

2. Payment and Service Continuation:

    • Cost per SMS: Each SMS will be charged at $0.08 per message.
    • Billing Cycle: Charges will be calculated and billed at the end of each month based on the total number of SMS messages sent.
    • Non-Payment Consequences: Failure to pay for the service will result in reduced reservation fee payouts.
    • Service Suspension: If payment is not made, the SMS service will be shut down immediately.

3. Consent and Use of Brand Name:
By using the Mass SMS Notifications service, campgrounds consent to the use of their name in SMS notifications sent to campers. The SMS sender name will be RoverPass by using the following phone number (737) 232-7448

4. Responsibility and Liability:

  • RoverPass Liability: RoverPass serves as a service provider, sending messages on behalf of the campground. It is not responsible for the content of messages, miscommunication, or any resulting damages.

  • Campground Responsibility: Campgrounds are responsible for ensuring the accuracy and appropriateness of SMS content. If a message fails to send, it will be reported, but the campground remains responsible for verifying delivery.

  • No Liability for Damages: RoverPass will not be held liable for any direct, indirect, incidental, or consequential damages related to the use of this service.

5. Compliance with U.S. SMS Regulations:

  • No Spam: Campgrounds must adhere to the Telephone Consumer Protection Act (TCPA) and all relevant U.S. laws. This includes obtaining explicit consent from recipients to receive SMS notifications. Sending unsolicited messages (spam) is strictly prohibited.

  • Opt-In Requirement: Campgrounds must ensure clear opt-in consent from campers before sending any SMS notifications. Consent can be collected during the check-in process, and campgrounds must provide an option for recipients to opt out of future messages.

  • Opt-Out Words: STOP, EXIT, UNSUBSCRIBE.

6. Service Disclaimer:
RoverPass is not responsible for issues related to miscommunication, inaccurate information, or consequences resulting from the use of the SMS service. It is the campground’s responsibility to review and verify all messages before sending.

7. Discontinuation of Service:
Users who wish to discontinue the service must email RoverPass before the 30th of each month. Failure to cancel before this deadline will be treated as consent for continued service and agreement to applicable charges.
