      AutoWaivers Terms of Service

      This article outlines the key aspects of AutoWaivers by RoverPass, an add-on service that automates the delivery and management of liability waivers for campground reservations.

      Service Description

      AutoWaivers is an add-on service that automates the sending of liability waivers to campers via email after they complete a reservation through the RoverPass system. The service includes:

      1. Automated email delivery of liability waivers to campers.

      2. Electronic signature capabilities for campers.

      3. Storage and delivery of signed waivers to the campground owner’s registered email address.

      4. A usage-based pricing structure of $0.99 per waiver sent.

      User Responsibilities

      1. Content of Waivers:

        1. Campground owners are solely responsible for the accuracy, legality, and completeness of the waiver templates provided.

        2. RoverPass does not review or guarantee the enforceability of any waiver content.

      2. Compliance:

        1. You are responsible for ensuring that your waivers comply with all applicable laws and regulations, including electronic signature laws in your jurisdiction.

      3. Authorized Use:

        1. You agree to use AutoWaivers only for lawful purposes and in compliance with these Terms.

      4. Data Security:

        1. You are responsible for protecting the confidentiality of your account credentials and ensuring that only authorized personnel have access to your account.

      Pricing and Payment

      1. Usage-Based Fees:

        1. Each waiver sent through AutoWaivers is billed at $0.99 per use.

        2. Fees are non-refundable, including cases where waivers are not signed by campers.

      2. Payment:

        1. Charges for AutoWaivers usage will be included in your regular RoverPass billing cycle.

        2. Payment terms are subject to your existing agreement with RoverPass.

      Limitations of Liability

      1. Disclaimer of Warranties:

        1. AutoWaivers is provided "as-is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

      2. Indemnification:

        1. You agree to indemnify and hold harmless RoverPass, its affiliates, and employees from any claims, damages, losses, or expenses arising out of:

        2. Your use of AutoWaivers.

        3. The content of your waivers.

        4. Any disputes with campers or third parties related to waivers sent using AutoWaivers.

      3. Limitation of Liability:

        1. RoverPass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of AutoWaivers.

        2. In no event shall RoverPass’s total liability exceed the total fees paid by you for AutoWaivers in the preceding 12 months.

      Termination

      1. Voluntary Termination:

        1. You may discontinue your use of AutoWaivers at any time by contacting RoverPass support: hostsupport@roverpass.com

      2. Suspension or Termination by RoverPass:

        1. RoverPass reserves the right to suspend or terminate your access to AutoWaivers for violations of these Terms or misuse of the service.

      3. Effect of Termination:

        1. Upon termination, all pending waivers will be canceled, and no further waivers will be sent.

      Data Privacy

      1. Collection of Data:

        1. AutoWaivers collects and processes personal information of campers, including names, email addresses, and waiver content, solely for the purpose of delivering and managing waivers.

      2. Data Storage and Security:

        1. All data is stored securely in compliance with applicable data protection regulations.

      3. Ownership:

        1. You retain ownership of the data and waiver content provided. RoverPass acts as a data processor for this service.

      Modifications to Terms

      RoverPass reserves the right to update these Terms at any time. Changes will be communicated through the RoverPass platform or via email. Continued use of AutoWaivers after changes are communicated constitutes acceptance of the updated Terms.
